Vizlume Terms of Service

Effective date pending counsel review

1. About these terms

These Terms of Service (“Terms”) govern your use of the Vizlume mobile app, the Vizlume organizer portal, and any related Vizlume service (together, the “Service”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

These Terms are a draft. A finalized version, reviewed by counsel, will replace this document before public launch.

2. Eligibility

You must be at least 18 years old to use the Service. By creating an account you confirm that you meet this minimum age. Misrepresenting your age is a material breach of these Terms and grounds for immediate termination of your account.

3. Your account

You are responsible for the accuracy of the information you provide and for keeping your account credentials confidential. You must promptly notify Vizlume if you believe your account has been accessed without authorization. Activity taken through your account is deemed to be activity by you, except where you have notified us of unauthorized access in advance.

4. Using Vizlume

Hunts are real-world activities that involve travelling to physical locations. You are responsible for your own safety while playing. You agree to exercise reasonable judgment about when and where to play, to follow local laws, and to follow directions or warnings from local authorities while in the field.

Vizlume reviews hunts before they are published, but we do not guarantee location conditions at any time. Locations may become unsafe between review and play due to weather, traffic, construction, crowds, or other factors outside our control. If a location feels unsafe at the time you visit it, leave the location.

Before starting a hunt you will be asked to confirm an in-app safety acknowledgement. By confirming, you accept responsibility for exercising your own judgment during play and agree that, in a genuine emergency, you will contact emergency services directly.

5. Acceptable use

You agree not to:

  • harass, threaten, or harm any other user;
  • use the Service in connection with any illegal activity or to violate any local, provincial, or federal law;
  • attempt to defraud the Service or any other user (for example, by submitting fake check-ins or attempting to bypass the geofence validation);
  • share your account credentials with another person, or play on another person’s behalf;
  • impersonate another person or misrepresent your affiliation with any organization;
  • probe, scan, or attempt to gain unauthorized access to any part of the Service or to other users’ accounts.

6. Reporting

If you encounter a safety or conduct concern during a hunt — an unsafe stop, harassment from an organizer, inappropriate clue content, a disputed prize, or anything else — please use the in-app reporting feature. Reports are reviewed by Vizlume administrators. The organizer being reported does not see the reporter’s identity.

7. Account suspension and termination

We may suspend or terminate your account if you breach these Terms, if your conduct creates a safety risk for other users, or if continued access creates a legal or operational risk for Vizlume. Where reasonable, we will tell you why; in some cases (for example, ongoing investigations) we may not be able to provide a detailed explanation immediately.

You may close your account at any time from the in-app account settings or the portal account screen.

8. Disclaimer of warranties

The Service is provided on an “as-is” and “as-available” basis. To the maximum extent permitted by applicable law, Vizlume disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by applicable law, Vizlume will not be liable for:

  • the safety or condition of physical locations selected by organizers;
  • the conduct of third-party organizers or other players;
  • the delivery, value, or condition of prizes offered by organizers;
  • indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Service.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so the limitations above may not apply to you in full.

10. Indemnification

You agree to defend, indemnify, and hold Vizlume harmless from any claim, loss, or damage (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, your conduct during a hunt, or your violation of any applicable law.

11. Privacy

Use of the Service is also governed by the Vizlume Privacy Policy, which explains what information we collect and how we handle it.

12. Changes to these terms

We may update these Terms as the Service evolves. For material changes we will notify users through the Service. Your continued use of the Service after a change indicates acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-laws rules. Subject to applicable law, any dispute arising under these Terms will be brought in the courts of [TBD with counsel].
